2. Scope of Application

These Terms apply to all purchases and interactions on https://sugess.co. Any differing conditions from the customer are not valid unless we explicitly agree to them in writing.

3. Products and Availability

We sell physical goods, including watches and accessories, under the Sugess brand. All product descriptions and availability are displayed on their respective product pages.

Some products marked as “backorder” or “procured upon order” aren’t kept in regular stock. These items will require additional processing time before shipping as they’re ordered to our warehouse before dispatch, not shipped directly from third-party sellers.

4. Order Process and Contract Conclusion

By placing an order, you’re making a binding offer to purchase the listed items. The purchase agreement becomes effective upon our confirmation email or, at the latest, upon shipment of the goods.

5. Prices and Payment

All prices shown include VAT (where applicable). Shipping costs will be displayed during checkout.

We accept the following payment methods:

• Credit/debit cards (via Stripe/WooPayments)
• PayPal
• Klarna

Your payment will be processed immediately upon completing your order.

6. Shipping and Delivery

We ship worldwide using trusted logistics partners such as UPS, DHL, DPD, and through our 3PL providers Quivo and Hive.

Delivery times for in-stock items:

• Germany: 1–3 business days
• EU: 3–7 business days
• Worldwide: 5–10 business days

For backorder items, please allow an additional 3–10 business days for procurement and processing before dispatch.

Shipment tracking is available upon request.

7. Cancellations

You may request to cancel your order before the item has been shipped. While we’ll do our best to accommodate your cancellation, we cannot guarantee it. Once the item is shipped, cancellation isn’t possible, and the product must be returned after delivery (see Section 8).

8. Returns and Refunds

You have the right to return items within 30 days of receipt.

• Items must be unused and in their original packaging.
• Return shipping is at the customer’s expense.
• Refunds are issued to the original payment method after we receive and inspect the return.

9. Right of Withdrawal (EU Customers)

Consumers within the European Union have a statutory right of withdrawal within 14 days of delivery. Detailed instructions and a model withdrawal form are provided on our Right of Withdrawal page.

This right doesn’t apply to custom-made or personalized items.

10. Liability

We are liable for damages only in cases of intent, gross negligence, or violation of essential contractual obligations. Liability for indirect or consequential damages is excluded unless legally required.

11. Data Protection

Your data will be collected, processed, and stored in accordance with our Privacy Policy, available at https://sugess.co/privacy-policy.

12. Governing Law and Jurisdiction

All legal relations are subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it doesn’t deprive them of mandatory protections of their country of residence.

Disputes will be resolved in the courts of Stralsund, Germany, unless otherwise required by applicable consumer protection laws.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Any changes will be published on this page and are effective immediately unless otherwise stated.
